Terms of Service

Effective: July 14, 2026. These Terms of Service (“Terms”) are a binding agreement between you and OTM App LLC (DBA "Own the Moment"), 1934 Old Gallows Rd, Ste 350, Vienna, Virginia 22182-4050, USA (“OTM App LLC,” “we,” “us,” “our”). They govern your access to and use of the Moment mobile app (the “App”) and the website at ownthemoment.app (the “Site,” and together with the App, the “Service”). By creating an account, using the App, or using the Site, you agree to these Terms, our Privacy Policy, and our End User License Agreement (EULA). If you do not agree, do not use the Service.

Not medical care, therapy, or a crisis service

Moment is an adults-only self-help and wellbeing tool that offers private behavioural support for the decision point. Moment is not a medical provider and does not provide medical advice, diagnosis, or treatment. It is not therapy, not a substitute for professional care, and not an emergency or crisis service. Nothing in the Service is a diagnosis or a promise of cure or recovery, and nothing in it should be relied on as such. Always seek the advice of a qualified health provider with any questions about a medical or mental-health condition.

If you are in immediate danger, at risk of harming yourself or someone else, or need urgent help, contact local emergency services now. In the United States you can call or text 988(Suicide & Crisis Lifeline), text HOME to 741741 (Crisis Text Line), or call 911. Moment cannot and does not provide emergency assistance.

Eligibility — 18+ only

You must be at least 18 years old to create an account or use the Service. Moment is intended for adults only and is not directed to anyone under 18. By using the Service you represent that you are 18 or older and that you can form a binding contract with us. We do not knowingly collect data from anyone under 18, and we refuse sign-ups that indicate an age under 18.

Your account

  • You are responsible for keeping your login credentials secure and for activity under your account.
  • You agree to provide accurate information and to keep it up to date.
  • You may delete your account and associated data at any time — in the App (Profile → Delete account) or at ownthemoment.app/delete-account.
  • We may suspend or terminate your account if you violate these Terms or use the Service unlawfully.

Subscriptions, billing, and trials

Moment offers an optional paid subscription with the following plans:

  • Monthly — $4.95 per month.
  • Annual — $29.95 per year.
  • Free trial — a 7-day free trial may be offered to new subscribers. If you do not cancel before the trial ends, it automatically converts to a paid subscription at the price above.

All subscriptions are sold and billed by the Apple App Store or Google Play (the “Stores”), under the Store’s own terms and payment methods — not directly by OTM App LLC. Prices are shown in the App and at purchase and may vary by region and over time. Payment is charged to your Store account at confirmation of purchase.

Auto-renewal. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the current period ends. Your Store account is charged for renewal within 24 hours before the period ends.

Manage or cancel your subscription — and turn off auto-renewal — in your Apple App Store or Google Play account settings at any time. Deleting the App or your Moment account does not cancel a subscription. Refunds, where available, are handled by the Store under its policies; we do not process Store payments or issue Store refunds directly.

Acceptable use

You agree not to:

  • use the Service in any unlawful manner or for any unlawful purpose;
  • use the Service on behalf of, or to collect information about, anyone under 18;
  • attempt to gain unauthorized access to the Service, its servers, or any related systems, or interfere with or disrupt their integrity or performance;
  • reverse engineer, decompile, or attempt to extract source code from the App except to the extent that restriction is prohibited by law;
  • copy, scrape, resell, or commercially exploit any part of the Service except as permitted by these Terms or applicable law;
  • upload unlawful content, or use the Service to harass, harm, or infringe the rights of others.

Data and privacy

Our Privacy Policy describes how we handle your information, including the sensitive inputs you provide in the App. Your consent is six separate choices: Care (required — it powers the core support engine) plus five optional, opt-in layers — Product analytics, Research, Commercial cohort, Health, and Location. The optional layers cover uses such as improving the app, de-identified research, and sharing aggregated, de-identifiedcohort insights (k ≥ 100) with our affiliate Hofund Labs LLC and vetted partners. Each optional layer is off by default and can be withdrawn at any time in the App. We do not sell your personal information. The Service works fully whether or not you grant any optional layer. Intellectual property and license

The Service and its contents — including the Moment and M marks, the “Own the Moment” name, software, text, graphics, and design — are owned by OTM App LLC or its licensors and are protected by intellectual property laws. Subject to these Terms and the EULA, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. No other rights are granted.

Third-party services

The Service relies on third parties — including the Apple App Store and Google Play (distribution and billing) and our hosting and infrastructure providers. Your use of the Stores is governed by their terms. We are not responsible for the content, policies, or practices of third parties.

Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will produce any particular outcome. Any reliance on the Service is at your own risk.

Limitation of liability

To the fullest extent permitted by law, OTM App LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the Service — even if advised of the possibility. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnity

You agree to indemnify and hold harmless OTM App LLC and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or of any law or the rights of a third party.

Changes to the Service and these Terms

We may modify or discontinue features of the Service, and we may update these Terms from time to time. When we make material changes we will revise the “Last updated” date above and, where appropriate, ask you to re-accept the updated Terms in the App. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Virginia for any dispute not subject to arbitration or small-claims resolution, except where applicable law gives you the right to bring a claim in your local courts.
